1. Introduction

These Terms and Conditions ("Terms") govern the use of the Satvik Certified website ("Website"), certification services, verification tools, and all related services (collectively, "Services") provided by Satvik Certified Pvt. Ltd. ("Satvik Certified," "we," "us," or "our").

By accessing this Website or using any of our Services, you ("User," "you," or "Applicant") agree to be bound by these Terms. If you do not agree, please discontinue use of the Website and Services immediately.

2. Nature of Certification

Satvik Certified is a private, independent certification framework. It is not a government authority, regulatory body, or statutory certification. Our certification is:

• Process-based: Awarded based on compliance with our published food preparation standards — not based on the religion, caste, ethnicity, or personal identity of the owner, staff, or customers.
• Voluntary: No business is required to obtain Satvik Certification. It is a market-recognized trust mark.
• Time-bound: Valid for a specific period (currently 24 months) subject to recurring inspections.
• Revocable: Can be suspended or revoked for non-compliance, misuse, or fraud.

3. Eligibility

Any food business operating in India with valid food safety licenses (e.g., FSSAI) may apply for Satvik Certification, regardless of the personal identity, religion, caste, or background of its owners or staff. Certification is awarded solely on the basis of compliance with our standards.

4. Application and Certification Process

• Submitting an application does not guarantee certification.
• Certification is granted only after successful completion of the audit process.
• Application fees are non-refundable regardless of the audit outcome.
• We reserve the right to reject any application that does not meet our eligibility criteria.
• The applicant is responsible for the accuracy of all submitted information.

5. Certification Mark and Intellectual Property

The Satvik Certified name, logo, certification badges, QR codes, and all related marks are the intellectual property of Satvik Certified Pvt. Ltd. and are protected under applicable trademark and intellectual property laws.

• Certified businesses receive a limited, non-transferable, revocable license to use the mark for the duration and scope of their certification.
• Use of the mark is restricted to the certified branches and products only.
• Unauthorized use, modification, or reproduction of the mark is strictly prohibited and may result in legal action.

6. Inspections and Compliance

• Certified businesses agree to allow Satvik Certified auditors access to their kitchen, storage, records, and food preparation areas during scheduled and unannounced inspections.
• Refusal to permit an inspection may result in immediate suspension of certification.
• Businesses must maintain compliance with all applicable standards throughout the certification period.

7. Suspension and Revocation

• Satvik Certified reserves the right to suspend or revoke certification at any time if a business fails to meet the required standards, engages in misuse of the mark, provides fraudulent information, or otherwise violates these Terms.
• Upon suspension or revocation, the business must immediately cease all use of the Satvik Certified mark, QR code, and any related materials.

8. Limitation of Liability

Satvik Certified provides verification and certification services based on audit evidence and documented assessments. We do not guarantee:

• Perpetual or real-time compliance by certified businesses.
• The safety or quality of food served by certified businesses beyond the scope of our audit.
• Any particular business outcome, revenue increase, or consumer preference as a result of certification.

To the maximum extent permitted by law, Satvik Certified, its directors, officers, employees, and agents shall not be liable for any direct, indirect, incidental, consequential, or punitive damages arising from the use of our Services, reliance on certification status, or any act or omission of a certified business.

9. Consumer Use of Verification Tools

The certificate verification tool and business directory are provided for informational purposes only. While we strive for accuracy, we do not warrant that the information is complete, current, or error-free at all times.

10. Privacy

Your use of this Website and Services is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

11. Governing Law

These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising under these Terms shall be subject to the exclusive jurisdiction of the courts of New Delhi, India.

12. Changes to These Terms

We reserve the right to modify these Terms at any time. Changes will be posted on this page with an updated effective date. Continued use of the Website or Services after changes constitutes acceptance of the revised Terms.
